Terms and conditions
1. Place and time
The contract applies to exhibitions produced by Possibility AS with the facilities rented and used for the event. In cases resulting from force majeure or other conditions, Possibility AS with cooperating organization(s) – referred to as the Producer below- may postpone or cancel the exhibition. Exhibitor may get his rent reimbursed, but can not claim any further compensation. If an exhibition needs to be cancelled, the exhibitor will be reimbursed the rent paid for a stand, except for fixed organizing expenses.
2. Division of stand area
The producer of the exhibition will attempt to coordinate the exhibition as best possible. Producer claims the right to pre-approve all items that are to be displayed in the exhibition. Exhibitors will receive a confirmation of stand area once all sales of stands are closed. The producer claims the right to stop registering and/or reduce former stated area of stands if exhibition is fully booked before application deadline. Stand area is appointed as best possible in the different groups of merchandise.
Subleasing of stand area is not allowed.
3. Registration
There will be no sign up registered prior to presentation of a completely filled out and signed contract/application form. The registration is binding and the exhibitor is responsible for 50 % of the total stand rental if you cancel 2 months before the exhibition take place. After this date the exhibitor is responsible of 100% the total stand rental. Registration fee is non-refundable.
4. Payment conditions and fees
Invoices for rent and various services are issued according to the following schedule:
- registration fee and stand rent - mid March with latest day of payment 15 April.
- various services- immediately after the Fair.
All invoices must be paid in full within 30 days (unless other arrangements have been made). In case of delayed payment, the exhibitor will be charged 12% interest and a reminder fee of NOK50,- (plus tax) per letter of reminder.
5. Missing payment
Failure to upheld payment conditions may lead to the loss of awarded stand area. In these cases producer has the right to utilize this area at the same terms as a cancellation (see point 3). Only registered exhibitors who has paid the registration fee can participate.
6. Debts and/or missing payments owed to Producer by exhibitor
Any debts and/or missing payments owed to Producer by exhibitor must be paid in full before the end of the exhibition, and not under any circumstances before exhibitor’s possessions are removed from exhibition area. Producer can claim ownership in any of exhibitor’s possessions until payment are made in full.
7. Tax
Because of taxes the exhibitors who sell directly to consumers, have to be registered with Avgiftsmantallet with the fylkes (state) tax-manager. International exhibitors who wish to sell goods directly to consumer, also need to be registered with the state tax-manager through a Norwegian tax-registered representative for all the same reasons as national exhibitors.
8. Returning the stand
When the exhibition has been dismantled the stand has to be returned without any signs of decorations, tape, fundaments, garbage or similar. If the exhibition hasn’t been properly dismantled and cleaned by given time, Producer holds the right to have the clearing of stand area done at exhibitor’s cost.
9. Decorations
All exhibitors may use their own decorator. Producer claims the right to approve exhibitor’s stand.
10. Rent
Producer can provide stand material for rent if this has been arranged within reasonable time before the exhibitions starts.
11. Insurance
The exhibitor ought to get an insurance which covers all kinds of damages that may occur when transporting the goods from exhibitor’s warehouse, office, pier or similar before and after the exhibition. Producer carries no responsibility for exhibitor’s goods and equipment during the exhibition. It is the responsibility of the exhibitor to make sure they get an insurance that covers this kind of damages.
12. Electricity
Producer will provide normal lighting where the exhibition is held. If additional power, power outlets, wires etc. are necessary, the exhibitor has to pay the extra costs. The ordering of this is done through producer. Connection to the exhibition facilities and stretching of cables to the stand, can only be done by the exhibition facilities’/Producer’s crew and cost will be charged to exhibitor. Connecting or sharing power with the neighbouring stand is strictly prohibited.
13. Security and cleaning
Producer provides security from last day of preparations and throughout the exhibition, but carries no responsibility for exhibitor’s goods, equipment and third party’s property. Exhibitor has to provide all necessary insurances in their own initiative. It is illegal to stay at the stand area except during regular opening hours.
Producer will provide cleaning of common area in addition to emptying litter boxes in the inside exhibition area. Cleaning of outdoor stand is the responsibility of the exhibitor.
14. Responsibility
The exhibitor carries full responsibility in cases of all damages and/or injuries on facilities and inventory caused by his employees, volunteers or random helpers. (regular HUSBONNANSVAR NL 3-21-2) The floor must be protected against oil spills, paint, and chemicals. The floor can be covered by carpets, linoleum, vinyl etc, but gluing materials to the floor or painting the floor is prohibited. Gluing, stapling or drilling in the floor is prohibited. There can not be made any changes by exhibitor in the exhibition facilities, inventory or other property. Bolting into floors, walls, columns or roofs/ceiling is prohibited and exhibitor will be held economically responsible in these cases.
15. Public areas
Exhibitor must abide by both standard and special regulations claimed by Producer, police and fire authorities.
16. DEMONSTRATIONS etc.
Films displayed, samples and demonstrations which cause the gathering of an audience, has to be planned in advance in order for the audience to get enough room at the stand. In case of audience causing blockage Producer claims the right to end demonstration or shorten demonstration time. OMSETNING must not take place without the written consent of Producer. Handing out samples or displaying food at the stand must be approved by Mattilsynet in Bergen.
17. Delivery
Deliveries of all supplies, equipment and objects for display must be delivered no later than 30 minutes prior to the opening of the exhibition.
18. Ads in exhibition newspaper etc.
If several exhibitors’ are represented at one stand, only the exhibitor whose name is on the registration form and has paid the registration fee will be displayed in the exhibition newspaper.
19. Rules
The rules stated above apply to every order independent of any requests made by exhibitor.
20. Force Majeure etc.
If the exhibition due to force majeure, fire, flooding etc must be cancelled, neither party can be held liable to each other. Producer cannot claim compensation from exhibitor except for all rent.
Circumstances beyond the control of Producer, in example stop in delivery of electricity, water, heat, tele- and communications network etc., does not give exhibitor any right to claim compensation or reimbursement of any rent.
21. Processing fee
There will be a processing fee of NOK50,- (plus tax) for each invoice
22. Disputes
Any disputes that may occur between exhibitor and Producer related to the exhibition or event, will be forwarded for decision making by voldgiftsmann appointed by Bergen Tingrett (Court of Bergen).
